TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF THE SERVICE.

6.3 Damage Cap

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS.

7. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including attorney's fees) arising from: (i) your use of the Service; (ii) your violation of these Terms; (iii) your violation of any third party rights; or (iv) any User Content you submit.

8. Digital Millennium Copyright Act (DMCA)

We respect intellectual property rights. If you believe your copyrighted work has been infringed, please provide our designated agent with written notice including the required information under the DMCA.

9. Modifications to Terms

We reserve the right to modify these Terms at any time, in our sole discretion. Changes will be effective immediately upon posting. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

10. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, and without liability to you or any third party.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of United States, without regard to conflict of law principles. You agree to submit to the personal jurisdiction of the courts located in Fresno, California for resolution of any disputes.

12. Arbitration Clause

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration will be conducted by a single arbitrator under the rules of American Arbitration Association (AAA). The arbitrator's decision will be final and binding. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTION LAWSUITS.

13. Severability

If any provision of these Terms is deemed invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Service and supersede all prior agreements and understandings.

15. Survival

Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law, and arbitration shall survive termination of these Terms.

16. Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
